ผู้ซึ่งได้แสดงความประสงค์ไว้ตามมาตรา ๕ มาตรา ๖หรือมาตรา ๗จะถอนคืน การแสดงความประสงค์นั้นมิได้ แต่ถ้าผู้แสดงความประสงค์ถึงแก่ความตายก่อนวันที่ ๑ ตุลาคม พ.ศ. ๒๕๕๘ ให้ถือว่าการแสดงความประสงค์เป็นอันสิ้นผล
