การยกเว้นไม่ให้นำบทบัญญัติใดแห่งพระราชบัญญัตินี้มาใช้บังคับแก่กิจกรรม ควบคุม หรือแก่สถานศึกษาตามกฎหมายว่าด้วยการศึกษาแห่งชาติ สถาบันอุดมศึกษาตามกฎหมาย ว่าด้วยการนั้น หรือหน่วยงานของรัฐ ให้ตราเป็นพระราชกฤษฎีกาตามข้อเสนอของคณะกรรมการ ทั้งนี้ การยกเว้นดังกล่าวจะกำหนดหลักเกณฑ์และเงื่อนไขให้ต้องปฏิบัติด้วยก็ได้ หลักเกณฑ์และเงื่อนไขตามวรรคหนึ่ง ให้เป็นไปตามที่กำหนดในกฎกระทรวง
