ในการพิจารณาคำร้องขอให้ส่งตัวเด็กกลับคืนนั้น ศาลอาจสั่งให้ผู้ร้องขอ ส่งคำวินิจฉัยชี้ขาดของศาลหรือองค์กรอื่นที่มีอำนาจวินิจฉัยชี้ขาดในประเทศที่เด็กมีถิ่นที่อยู่ปกติที่แสดงว่า การพาตัวเด็กมาหรือกักตัวเด็กเป็นการละเมิดสิทธิควบคุมดูแลเด็กมาใช้ประกอบการวินิจฉัยว่าจะส่งตัวเด็ก กลับคืนหรือไม่ก็ได้
