ผู้ที่จะได้รับการแต่งตั้งเป็นเลขาธิการต้องมีคุณสมบัติ ดังต่อไปนี้
(๑) มีสัญชาติไทย
(๒) มีอายุไม่เกินหกสิบห้าปีบริบูรณ์
(๓) สามารถทำงานให้แก่สำนักงานได้เต็มเวลา เล่ม ๑๓๔ ตอนที่ ๗๐ ก
(๔) มีความรู้ความเชี่ยวชาญในสาขานิติศาสตร์ เศรษฐศาสตร์ การเงิน การบัญชี อุตสาหกรรม การบริหารธุรกิจ การคุ้มครองผู้บริโภค หรือในสาขาอื่นตามที่คณะกรรมการประกาศ กำหนด
(๕) คุณสมบัติอื่นตามที่คณะกรรมการประกาศกำหนด
