ให้มีคณะกรรมการคณะหนึ่งเรียกว่า “คณะกรรมการการแข่งขันทางการค้า” ประกอบด้วย ประธานกรรมการ รองประธานกรรมการหนึ่งคน และกรรมการอื่นอีกห้าคน ซึ่งนายกรัฐมนตรี แต่งตั้งจากบุคคลที่ผ่านการคัดเลือกโดยความเห็นชอบของคณะรัฐมนตรี ให้เลขาธิการเป็นเลขานุการคณะกรรมการ
