กรรมการต้องเป็นผู้ที่มีผลงานหรือเคยปฏิบัติงานที่แสดงให้เห็นถึงการเป็นผู้มีความรู้ และมีความเชี่ยวชาญหรือมีประสบการณ์ไม่น้อยกว่าสิบปี ในสาขานิติศาสตร์ เศรษฐศาสตร์ การเงิน การบัญชี อุตสาหกรรม การบริหารธุรกิจ การคุ้มครองผู้บริโภค หรือในสาขาอื่น อันจะเป็นประโยชน์ต่อการกำกับดูแล การแข่งขันทางการค้า ทั้งนี้ การนับระยะเวลาข้างต้นให้นำมารวมกันได้
