ในกรณีที่กรรมการหรือที่ปรึกษาในคณะกรรมการตามประกาศและคำสั่งของ คณะรักษาความสงบแห่งชาติตามมาตรา ๓พ้นจากตำแหน่งไม่ว่าด้วยเหตุใด ให้หัวหน้าคณะรักษาความสงบ แห่งชาติมีอำนาจแต่งตั้งบุคคลที่เห็นสมควรเป็นกรรมการหรือที่ปรึกษาแทนได้ ในระหว่างที่ยังมิได้ มีการแต่งตั้งกรรมการหรือที่ปรึกษาแทน ให้คณะกรรมการดังกล่าวประกอบด้วยกรรมการและที่ปรึกษา เท่าที่มีอยู่
