นอกจากการพ้นจากตำแหน่งตามวาระ กรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่งเมื่อ
(๑) ตาย
(๒) ลาออก
(๓) เป็นคนไร้ความสามารถหรือเสมือนไร้ความสามารถ
(๔) รัฐมนตรีให้ออก เพราะบกพร่องต่อหน้าที่ มีความประพฤติเสื่อมเสีย หรือหย่อนความสามารถ
(๕) ได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก เว้นแต่เป็นโทษสำหรับความผิดที่ได้กระทำ โดยประมาทหรือความผิดลหุโทษ
