เจ้าหน้าที่และลูกจ้างพ้นจากตำแหน่งเมื่อ
(๑) ตาย
(๒) ลาออก
(๓) ขาดคุณสมบัติหรือมีลักษณะต้องห้ามอย่างหนึ่งอย่างใดตามมาตรา ๔๔
(๔) ถูกให้ออก เพราะไม่ผ่านการประเมินผลงานตามหลักเกณฑ์และวิธีการที่คณะกรรมการ กำหนด
(๕) ถูกไล่ออกหรือปลดออก เพราะผิดวินัยตามหลักเกณฑ์และวิธีการที่คณะกรรมการกำหนด การขาดคุณสมบัติเพราะมีอายุเกินหกสิบปีบริบูรณ์ ให้ถือว่าเป็นการพ้นจากตำแหน่ง ตามกำหนดเวลาในสัญญาจ้าง เลม่ ๑๓๖ ตอนที่ ๕๖ ก หนา้ ๓๔
