เมื่อมีเหตุอันควรสงสัยหรือความปรากฏต่อเจ้าหน้าที่ของรัฐว่ามีการกระทำความผิด ทางพินัยเกิดขึ้น ไม่ว่าเจ้าหน้าที่ของรัฐพบเห็นเอง มีการกล่าวหา หรือความปรากฏด้วยวิธีอื่นใด ให้เจ้าหน้าที่ของรัฐเริ่มการแสวงหาข้อเท็จจริงโดยมิชักช้า ในกรณีที่ความตามวรรคหนึ่งปรากฏต่อข้าราชการและพนักงานของหน่วยงานของรัฐ ให้เป็นหน้าที่ของข้าราชการและพนักงานของหน่วยงานของรัฐที่จะต้องแจ้งให้เจ้าหน้าที่ของรัฐทราบ
