ให้เจ้าหน้าที่ของรัฐรวบรวมพยานหลักฐานทุกชนิดเท่าที่สามารถจะทำได้ เพื่อให้ ได้มาซึ่งข้อเท็จจริงและพฤติการณ์ต่าง ๆ อันเกี่ยวกับการกระทำความผิดทางพินัย เพื่อให้รู้ว่า มีการกระทำความผิดทางพินัยหรือไม่และใครเป็นผู้กระทำความผิด และในกรณีที่ผู้ถูกกล่าวหา เสนอพยานหลักฐานใด ๆ เพื่อแสดงความบริสุทธิ์ของตน ให้เป็นหน้าที่ของเจ้าหน้าที่ของรัฐที่จะต้อง รวบรวมพยานหลักฐานนั้นไว้ในสำนวนการแสวงหาข้อเท็จจริง
