เมื่อคณะกรรมการ วลพ. มีคำวินิจฉัยว่ามีการเลือกปฏิบัติโดยไม่เป็นธรรม ระหว่างเพศ ให้ผู้เสียหายมีสิทธิขอรับการชดเชยและเยียวยาโดยยื่นคำขอต่อกรมตามแบบที่อธิบดี ประกาศกำหนดภายในหนึ่งปีนับแต่วันที่ได้รับแจ้งคำวินิจฉัยของคณะกรรมการ วลพ. เล่ม ๑๓๒ ตอนที่ ๑๘ ก สิทธิขอรับการชดเชยและเยียวยาตามวรรคหนึ่ง เป็นสิทธิเฉพาะตัวไม่อาจโอนกันได้และไม่ตกทอด ทางมรดก
