ในกรณีที่ผู้เสียหายเป็นผู้เยาว์ คนเสมือนไร้ความสามารถหรือคนไร้ความสามารถ หรือในกรณีที่ผู้เสียหายไม่สามารถยื่นคำขอรับการชดเชยและเยียวยาด้วยตนเองได้ ผู้ปกครอง ผู้พิทักษ์ ผู้อนุบาล สามีหรือภริยา ผู้ดูแลหรือบุคคลอื่นใดเพื่อประโยชน์ของผู้เสียหาย แล้วแต่กรณี จะยื่นคำขอแทน ก็ได้ ทั้งนี้ ตามหลักเกณฑ์และวิธีการที่อธิบดีประกาศกำหนด
