ในกรณีที่ผู้กระทำความผิดซึ่งต้องรับโทษอาญาตามพระราชบัญญัตินี้เป็นนิติบุคคล ถ้าการกระทำความผิดของนิติบุคคลนั้นเกิดจากการสั่งการหรือไม่สั่งการ หรือการกระทำการหรือไม่กระทำการ อันเป็นหน้าที่ที่ต้องกระทำของกรรมการ ผู้จัดการ หรือผู้มีอำนาจในการจัดการแทนนิติบุคคลนั้น บุคคลดังกล่าว ต้องรับโทษตามที่บัญญัติไว้สำหรับความผิดนั้นๆด้วย
