ภายใต้บังคับบทบัญญัติวรรคสองและวรรคสาม การจัดสรรเงินกำไรสุทธิของ รัฐวิสาหกิจเพื่อนำส่งคลัง ให้เป็นไปตามวิธีการที่กำหนดไว้ในกฎหมายจัดตั้งรัฐวิสาหกิจนั้น ให้รัฐวิสาหกิจที่ไม่อยู่ในบังคับต้องเสียภาษีเงินได้นิติบุคคลจัดสรรกำไรสุทธิประจำปีเพื่อนำส่งคลัง ในอัตราไม่น้อยกว่าอัตราภาษีเงินได้นิติบุคคล ในกรณีที่เห็นสมควร กระทรวงการคลังจะกำหนดให้รัฐวิสาหกิจจัดสรรกำไรสุทธิหรือกำไรสะสม เพื่อนำส่งคลังเพิ่มเติมจากวรรคสองในจำนวนที่กระทรวงการคลังเห็นสมควรก็ได้
