หน่วยงานของรัฐจะก่อหนี้ผูกพันหรือจ่ายเงินได้ก็แต่โดยอาศัยอำนาจที่มีอยู่ ตามกฎหมาย การก่อหนี้ผูกพันและการใช้จ่ายเงินของหน่วยงานของรัฐในการปฏิบัติหน้าที่หรือการดำเนินงาน ต้องเป็นไปอย่างโปร่งใส คุ้มค่าและประหยัด โดยพิจารณาเป้าหมาย ประโยชน์ที่ได้รับ ผลสัมฤทธิ์ และ ประสิทธิภาพของหน่วยงานของรัฐ และต้องเป็นไปตามรายการและวงเงินงบประมาณรายจ่ายของหน่วยงาน ของรัฐนั้นด้วย
