ผู้ประกอบการทุกคนต้องร่วมกันรับผิดต่อผู้เสียหายในความเสียหายที่เกิดจาก สินค้าที่ไม่ปลอดภัย และสินค้านั้นได้มีการขายให้แก่ผู้บริโภคแล้ว ไม่ว่าความเสียหายนั้นจะเกิดจาก การกระทำโดยจงใจหรือประมาทเลินเล่อของผู้ประกอบการหรือไม่ก็ตาม
