เพื่อให้ผู้ประกอบการต้องรับผิดตามมาตรา ๕ผู้เสียหายหรือผู้มีสิทธิฟ้องคดีแทน ตามมาตรา ๑๐ ต้องพิสูจน์ว่าผู้เสียหายได้รับความเสียหายจากสินค้าของผู้ประกอบการและการใช้ หรือการเก็บรักษาสินค้านั้นเป็นไปตามปกติธรรมดา แต่ไม่ต้องพิสูจน์ว่าความเสียหายเกิดจากการกระทำ ของผู้ประกอบการผู้ใด
