ถ้ามีการเจรจาเกี่ยวกับค่าเสียหายที่พึงจ่ายระหว่างผู้ประกอบการและผู้เสียหาย หรือผู้มีสิทธิฟ้องคดีแทนตามมาตรา ๑๐ ให้อายุความสะดุดหยุดอยู่ไม่นับในระหว่างนั้นจนกว่าฝ่ายใด ฝ่ายหนึ่งได้บอกเลิกการเจรจา
