กรรมการผู้ทรงคุณวุฒิมีวาระอยู่ในตำแหน่งคราวละสองปีนับแต่วันที่ได้รับแต่งตั้ง และอาจได้รับแต่งตั้งอีกได้แต่ต้องไม่เกินสองวาระติดต่อกัน ให้กรรมการผู้ทรงคุณวุฒิที่พ้นจากตำแหน่งตามวาระปฏิบัติหน้าที่ต่อไปจนกว่าจะมีการแต่งตั้ง กรรมการผู้ทรงคุณวุฒิขึ้นใหม่ ในกรณีที่กรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่งก่อนครบวาระ ให้ผู้ได้รับแต่งตั้งให้ ดำรงตำแหน่งแทนอยู่ในตำแหน่งเท่ากับวาระที่เหลืออยู่ของกรรมการผู้ทรงคุณวุฒิซึ่งได้รับแต่งตั้งไว้แล้ว
