นอกจากการพ้นจากตำแหน่งตามวาระตามมาตรา ๗ กรรมการผู้ทรงคุณวุฒิ ตามมาตรา ๕
(๓) พ้นจากตำแหน่งเมื่อ
(๑) ตาย
(๒) ลาออก
(๓) รัฐมนตรีให้ออก เพราะบกพร่องต่อหน้าที่ มีความประพฤติเสื่อมเสีย หรือหย่อนความสามารถ
(๔) ขาดคุณสมบัติหรือมีลักษณะต้องห้ามตามมาตรา ๖
(๕) ต้องโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก เว้นแต่เป็นโทษสำหรับความผิดที่ได้กระทำ โดยประมาทหรือความผิดลหุโทษ เล่ม ๑๓๓ ตอนที่ ๑๙ ก
