นอกจากการพ้นจากตำแหน่งตามวาระ กรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่ง เมื่อ
(๑) ตาย
(๒) ลาออก
(๓) คณะรัฐมนตรีมีมติให้ออก เพราะบกพร่องต่อหน้าที่ มีความประพฤติเสื่อมเสีย หรือ หย่อนความสามารถ
(๔) ได้รับโทษจำคุกโดยคำพิพากษาถึงที่สุดให้จำคุก เว้นแต่เป็นโทษสำหรับความผิดที่ได้ กระทำโดยประมาทหรือความผิดลหุโทษ
(๕) ขาดคุณสมบัติหรือมีลักษณะต้องห้ามตามมาตรา ๕ เลม่ ๑๓๖ ตอนที่ ๔๙ ก หนา้ ๔
