ในกรณีที่กรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่งก่อนวาระ ให้ดำเนินการแต่งตั้งผู้อื่น ดำรงตำแหน่งแทนเว้นแต่วาระของกรรมการผู้ทรงคุณวุฒิเหลืออยู่ไม่ถึงเก้าสิบวัน และให้ผู้ได้รับ การแต่งตั้งแทนตำแหน่งที่ว่างอยู่ในตำแหน่งเท่ากับวาระที่เหลืออยู่ของกรรมการผู้ทรงคุณวุฒิซึ่งได้รับ การแต่งตั้งไว้แล้ว ในระหว่างที่กรรมการผู้ทรงคุณวุฒิพ้นจากตำแหน่ง ไม่ว่าด้วยเหตุใด และยังมิได้มีการแต่งตั้ง กรรมการผู้ทรงคุณวุฒิขึ้นใหม่ ให้ คทช. ประกอบด้วยกรรมการเท่าที่เหลืออยู่
