ผู้ต้องขังมีสิทธิร้องเรียนเกี่ยวกับการถูกล่วงละเมิดทางเพศจากการปฏิบัติหน้าที่ โดยมิชอบของเจ้าพนักงานของเรือนจำได้ โดยให้ได้รับความคุ้มครองและให้คำปรึกษาในทันที รวมทั้ง คำร้องดังกล่าวต้องรักษาเป็นความลับและได้รับการไต่สวนชี้ขาดโดยพนักงานอัยการ ทั้งนี้ ตามหลักเกณฑ์ วิธีการ และเงื่อนไขที่กำหนดในกฎกระทรวง ในกรณีตามวรรคหนึ่ง หากผู้ต้องขังซึ่งเป็นหญิงและตั้งครรภ์ให้นำบทบัญญัติมาตรา ๕๙ มาใช้บังคับด้วยโดยอนุโลม
