ในกรณีที่ที่ประชุมใหญ่ศาลฎีกามีคำสั่งยกคำร้อง หรือมีคำวินิจฉัยว่า บทบัญญัติแห่งกฎหมายยังมีความจำเป็นหรือสอดคล้องกับสภาพการณ์ หรือไม่เป็นอุปสรรคต่อ การดำรงชีวิตหรือการประกอบอาชีพ ให้ศาลฎีกาแจ้งให้ศาลทราบเพื่อแจ้งให้ผู้ร้องและผู้คัดค้านทราบ โดยเร็ว แล้วให้ศาลดำเนินการพิจารณาและมีคำพิพากษาคดีต่อไป
