ให้เจ้าหน้าที่ของรัฐซึ่งดำรงตำแหน่งระดับชำนาญการขึ้นไปหรือเทียบเท่า ตามข้อ ๑(๑) -
(๔) มีอำนาจปรับเป็นพินัยในความผิดดังกล่าว ได้ทั่วราชอาณาจักร
