ในการดำเนินการปรับเป็นพินัยในความผิดทางพินัยตามพระราชบัญญัติ การขนส่งทางบก พ.ศ. ๒๕๒๒และพระราชบัญญัติรถยนต์ พ.ศ. ๒๕๒๒ที่มีอัตราอย่างสูงไม่เกิน หนึ่งหมื่นบาท ให้ข้าราชการซึ่งเป็นเจ้าหน้าที่ของรัฐผู้มีอำนาจปรับเป็นพินัยในข้อ ๒หรือข้อ ๓ คนเดียวเป็นผู้มีอำนาจปรับเป็นพินัย
