[๘๘] ในคดีที่เรียกร้องให้ชำระหนี้เป็นเงิน หรือมีการเรียกร้องให้ชำระหนี้เป็นเงิน รวมอยู่ด้วยไม่ว่าเวลาใดๆก่อนมีคำพิพากษาจำเลยจะนำเงินมาวางศาลเต็มจำนวนที่เรียกร้องหรือแต่บางส่วนหรือ ตามจำนวนเท่าที่ตนคิดว่าพอแก่จำนวนที่โจทก์มีสิทธิเรียกร้องก็ได้ ทั้งนี้ โดยยอมรับผิดหรือไม่ยอมรับผิดก็ได้
