ในคดีที่เรียกร้องให้ชำระหนี้อย่างอื่นนอกจากให้ชำระเงิน จำเลยชอบที่จะทำการ ชำระหนี้นั้นได้โดยแจ้งให้ศาลทราบในคำให้การหรือแถลงโดยหนังสือเป็นส่วนหนึ่งต่างหากก็ได้ ถ้าโจทก์ยอมรับการชำระหนี้นั้นเป็นการพอใจเต็มตามที่เรียกร้องแล้ว ให้ศาลพิพากษาคดีไป ตามนั้น และคำพิพากษานั้นให้เป็นที่สุด ถ้าโจทก์ไม่พอใจในการชำระหนี้เช่นว่านั้น โจทก์ชอบที่จะดำเนินคดีนั้นต่อไปได้
