ผู้ใดขายของโดยหลอกลวงด้วยประการใด ๆให้ผู้ซื้อหลงเชื่อใน แหล่งกำเนิด สภาพคุณภาพหรือปริมาณแห่งของนั้นอันเป็นเท็จถ้าการกระทำนั้นไม่เป็นความผิดฐาน ฉ้อโกง ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกพันบาท หรือทั้งจำทั้งปรับ
