ในการคำนวณการเพิ่มโทษหรือลดโทษที่จะลง ให้ศาลตั้งกำหนดโทษที่ จะลงแก่จำเลยเสียก่อนแล้วจึงเพิ่มหรือลดถ้ามีทั้งการเพิ่มและการลดโทษที่จะลง ให้เพิ่มก่อนแล้วจึง ลดจากผลที่เพิ่มแล้วนั้น ถ้าส่วนของการเพิ่มเท่ากับหรือมากกว่าส่วนของการลด และศาลเห็นสมควร จะไม่เพิ่มไม่ลดก็ได้
