เมื่ อความปรากฏแก่ศาลเอง หรือความปรากฏตามคำแถลงของ พนักงานอัยการหรือเจ้าพนักงานว่า ผู้กระทำความผิดไม่ปฏิบัติตามเงื่อนไขดังที่ศาลกำหนดตาม มาตรา ๕๖ศาลอาจตักเตือนผู้กระทำความผิดหรือจะกำหนดการลงโทษที่ยังไม่ได้ำหนดหรือลงโทษ ซึ่งรอไว้นั้นก็ได้
