ผู้ใดกระทำตามคำสั่งของเจ้าพนักงาน แม้คำสั่งนั้นจะมิชอบด้วย กฎหมายถ้าผู้กระทำมีหน้าที่หรือเชื่อโดยสุจริตว่ามีหน้าที่ต้องปฏิบัติตาม ผู้นั้นไม่ต้ องรับโทษเว้นแต่ จะรู้ว่าคำสั่งนั้นเป็นคำสั่งซึ่งมิชอบด้วยกฎหมาย
