ผู้ใดอายุกว่าสิบห้าปีแต่ต่ำกว่าสิบแปดปี กระทำการอันกฎหมาย บัญญัติเป็นความผิด ให้ศาลพิจารณาถึงความรู้ผิดชอบและสิ่งอื่นทั้งปวงเกี่ยวกับผู้นั้น ในอันที่จะควร วินิจฉัยว่าสมควรพิพากษาลงโทษผู้นั้นหรือไม่ ถ้าศาลเห็นว่าไม่สมควรพิพากษาลงโทษก็ให้จัดการตาม มาตรา ๗๔หรือถ้าศาลเห็นว่าสมควรพิพากษาลงโทษ ก็ให้ลดมาตราส่วนโทษที่กำหนดไว้สำหรับ ความผิดลงกึ่งหนึ่ง
