ที่ดินของรัฐซึ่งมิได้มีบุคคลใดมี การขอสัมปทาน สิทธิครอบครองรัฐมนตรีมีอำนาจให้สัมปทานให้ หรือให้ใช้ในระยะเวลาอันจำกัด ทั้งนี้ ให้เป็นไปตาม หลักเกณฑ์และวิธีการที่กำหนดในกฎกระทรวง** บทบัญญัติในมาตรานี้ไม่กระทบกระเทือนถึง กฎหมายว่าด้วยการเหมืองแร่และการป่าไม้
