บุคคลย่อมมีกรรมสิทธิ์ในที่ดินใน ที่ดินเอกชน (กรรมสิทธิ์ในที่ดิน) กรณีต่อไปนี้ (๑)ได้มาซึ่งกรรมสิทธิ์ตามบทกฎหมายก่อน วันที่ประมวลกฎหมายนี้ใช้บังคับหรือได้มาซึ่งโฉนด ที่ดินตามบทแห่งประมวลกฎหมายนี้ (๒)ได้มาซึ่งกรรมสิทธิ์ตามกฎหมายว่าด้วย การจัดที่ดินเพื่อการครองชีพหรือกฎหมายอื่น
