ในกรณีที่อธิบดีจะใช้อำนาจจำหน่าย สิทธิในการตกลง ที่ดินตามประมวลกฎหมายนี้ให้ผู้มีสิทธิในที่ดินอันจะ กำหนดแปลง พึงจำหน่ายตกลงกับพนักงานเจ้าหน้าที่ว่าที่ดินแปลงใด จำหน่าย หรือส่วนของที่ดินตอนใดจะพึงจำหน่ายถ้าไม่สามารถ ตกลงกันได้ให้เสนอเรื่องให้คณะกรรมการชี้ขาด
