ให้มี ณะกรรมการวิ จฉัยภาษีอากรประกอบด้วย ปลัด กระทรวงการคลังเป็นประธานกรรมการ อธิบดีกรมสรรพากร อธิบดีกรมศุลกากร อธิบดีกรม สรรพสามิต ผู้อำนวยการสำนักงานเศรษฐกิจการคลัง เลขาธิการคณะกรรมการกฤษฎีกา และ ผู้ทรงคุณวุฒิอีกจำนวนสามคนซึ่งรัฐมนตรีแต่งตั้งเป็นกรรมการ ให้คณะกรรมการแต่งตั้งข้าราชการสังกัดกระทรวงการคลังเป็นเลขานุการและ ผู้ช่วยเลขานุการ
