ให้อธิบดีหรือผู้ซึ่งอธิบดีมอบหมายสั่งให้ดอกเบี้ยแก่ผู้ได้รับคืนเงิน ภาษีอากรในอัตราร้อยละ๑ต่อเดือนหรือเศษของเดือนของเงินภาษีอากรที่ได้รับคืนโดยไม่คิดทบต้น ๒๕๐๒ ๒๕๐๒ ๒๕๐๒ ๒๕๐๒ ทั้งนี้ ตามหลักเกณฑ์และเงื่อนไขที่กำหนดโดยกฎกระทรวง ดอกเบี้ ยที่ให้ตามวรรคหนึ่งมิให้เกินกว่าจำนวนเงิ ภาษีอากรที่ได้ับคื และให้จ่าย จากเงินภาษีอากรที่จัดเก็บได้ตามประมวลรัษฎากรนี้
