ผู้ใดผลิต นำเข้า หรือส่งออกซึ่งยาเสพติดให้โทษในประเภท ๒ ประเภท ๓ หรือประเภท ๕ หรือวัตถุออกฤทธิ์ในประเภท ๒ ประเภท ๓ หรือประเภท ๔ ปลอม อันเป็น การฝ่าฝืนมาตรา ๕๒ ต้องระวางโทษจำคุกไม่เกินสิบปี และปรับไม่เกินหนึ่งล้านบาท ผู้ใดจำหน่ายซึ่งยาเสพติดให้โทษหรือวัตถุออกฤทธิ์ปลอม อันเป็นการฝ่าฝืนมาตรา ๕๒ ต้องระวางโทษจำคุกไม่เกินเจ็ดปี และปรับไม่เกินเจ็ดแสนบาท
