ผู้ใดส่งออกซึ่งวัตถุออกฤทธิ์ไปยังประเทศที่ระบุห้ามนำเข้าโดยไม่ได้รับใบอนุญาต พิเศษเฉพาะคราวจากประเทศนั้นและใบอนุญาตพิเศษเฉพาะคราวจากเลขาธิการ อย. อันเป็นการฝ่าฝืน มาตรา ๔๔ วรรคสอง ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ
