ผู้ใดส่งวัตถุออกฤทธิ์ที่ได้รับอนุญาตนำเข้าไปยังบุคคลอื่นหรือสถานที่อื่น นอกเหนือไปจากที่ระบุในใบอนุญาตเฉพาะคราวเพื่อนำเข้าโดยไม่ได้รับอนุญาตอันเป็นการไม่ปฏิบัติ ตามมาตรา ๔๓ ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ
