ผู้ใดโดยไม่ได้รับอนุญาตจากเลขาธิการ อย. แปรรูปหรือแปรสภาพวัตถุออกฤทธิ์ ให้เป็นอย่างอื่น หรือเปลี่ยนหีบห่อที่บรรจุวัตถุออกฤทธิ์โดยไม่มีเหตุอันสมควร อันเป็นการไม่ปฏิบัติ ตามมาตรา ๔๒ ต้องระวางโทษจำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ เลม่ ๑๓๘ ตอนที่ ๗๓ ก หนา้ ๖๖
