ผู้ใดเปลี่ยนแปลงจุดหมายในการส่งวัตถุออกฤทธิ์อันเป็นการฝ่าฝืนมาตรา ๔๑ วรรคหนึ่ง หรือไม่ส่งวัตถุออกฤทธิ์กลับคืนไปยังประเทศที่ส่งออกตามมาตรา ๔๑ วรรคสอง ต้องระวางโทษ จำคุกไม่เกินสามปี หรือปรับไม่เกินหกหมื่นบาท หรือทั้งจำทั้งปรับ
