ผู้ใดโฆษณาเกี่ยวกับยาเสพติดให้โทษหรือวัตถุออกฤทธิ์โดยไม่ได้รับอนุญาต ตามมาตรา ๓๗ ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสองแสนบาท หรือทั้งจำทั้งปรับ ถ้าการกระทำตามวรรคหนึ่งเป็นการกระทำของเจ้าของสื่อโฆษณาหรือผู้ประกอบกิจการโฆษณา ผู้กระทำต้องระวางโทษเช่นเดียวกันกับผู้โฆษณา ผู้กระทำความผิดซึ่งต้องรับโทษตามวรรคหนึ่งหรือวรรคสอง ยังต้องระวางโทษปรับอีกวันละไม่เกิน หนึ่งหมื่นบาท ตลอดระยะเวลาที่ยังฝ่าฝืนหรือจนกว่าจะได้ปฏิบัติให้ถูกต้อง
