ผู้ใดผลิตหรือนำเข้าสารระเหย โดยก่อนนำออกจำหน่ายไม่จัดให้มีภาพ เครื่องหมาย หรือข้อความที่ภาชนะบรรจุหรือหีบห่อที่บรรจุสารระเหย อันเป็นการฝ่าฝืนมาตรา ๙๗ ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ
