ผู้ใดจำหน่ายสารระเหยโดยไม่มีภาพ เครื่องหมาย หรือข้อความ ที่ผู้ผลิตหรือ ผู้นำเข้าสารระเหยต้องจัดให้มีที่ภาชนะบรรจุหรือหีบห่อที่บรรจุตามมาตรา ๙๗ อยู่ครบถ้วน อันเป็น การฝ่าฝืนมาตรา ๙๘ ต้องระวางโทษจำคุกไม่เกินสองปี หรือปรับไม่เกินสี่หมื่นบาท หรือทั้งจำทั้งปรับ
