ผู้ใดผลิต นำเข้า ส่งออก หรือจำหน่ายซึ่งยาเสพติดให้โทษหรือวัตถุออกฤทธิ์ ที่ต้องขึ้นทะเบียนตำรับยาเสพติดให้โทษหรือตำรับวัตถุออกฤทธิ์ตามมาตรา ๔๙ แต่มิได้ขึ้นทะเบียน ตำรับยาเสพติดให้โทษหรือตำรับวัตถุออกฤทธิ์ อันเป็นการฝ่าฝืนมาตรา ๑๐๒ ต้องระวางโทษจำคุก ไม่เกินสามปี หรือปรับไม่เกินสามแสนบาท หรือทั้งจำทั้งปรับ
