ผู้ใดผลิต นำเข้า หรือส่งออกซึ่งยาเสพติดให้โทษหรือวัตถุออกฤทธิ์ที่ รัฐมนตรีว่าการกระทรวงสาธารณสุขสั่งเพิกถอนทะเบียนตำรับยาเสพติดให้โทษหรือตำรับวัตถุออกฤทธิ์ ตามมาตรา ๕๑ อันเป็นการฝ่าฝืนมาตรา ๑๐๓ ต้องระวางโทษจำคุกไม่เกินเจ็ดปี และปรับไม่เกิน เจ็ดแสนบาท ผู้ใดจำหน่ายซึ่งยาเสพติดให้โทษหรือวัตถุออกฤทธิ์ที่รัฐมนตรีว่าการกระทรวงสาธารณสุข สั่งเพิกถอนทะเบียนตำรับยาเสพติดให้โทษหรือวัตถุออกฤทธิ์ตามมาตรา ๕๑ อันเป็นการฝ่าฝืนมาตรา ๑๐๓ ต้องระวางโทษจำคุกไม่เกินสามปี และปรับไม่เกินสามแสนบาท
