ผู้ใดเสพยาเสพติดให้โทษในประเภท ๑ ประเภท ๒ หรือประเภท ๕ หรือ เสพวัตถุออกฤทธิ์ในประเภท ๑ หรือประเภท ๒ และมิใช่กรณีตามมาตรา ๑๑๓ หรือมาตรา ๑๑๔ อันเป็นการฝ่าฝืนมาตรา ๑๐๔ ต้องระวางโทษจำคุกไม่เกินหนึ่งปี หรือปรับไม่เกินสองหมื่นบาท หรือ ทั้งจำทั้งปรับ
